Short version: no ads, and we never sell your data. The website uses no cookies and only counts visits anonymously. The app will only use the data it needs, and asks before collecting any usage statistics.

This policy follows the Swiss Federal Act on Data Protection (FADP) and, for visitors in the EU and EEA, the General Data Protection Regulation (GDPR).

When you visit the website

The site is hosted by Netlify, Inc., San Francisco, USA. To deliver pages and protect the site against abuse, Netlify's servers process technical data your browser sends with every request: IP address, date and time, the page requested, browser type and the referring page. We do not use this data to identify you.

Legal basis: our legitimate interest in running a secure, working website (GDPR Art. 6(1)(f)). Because Netlify is based in the USA, data may be processed there. Such transfers rely on the safeguards required by law, such as the EU Standard Contractual Clauses in Netlify's data processing agreement.

Fonts are served from our own website. We do not load anything from Google, and we use no cookies, tracking pixels or advertising.

Visitor statistics

To see how many people visit, which pages they read, which site or search engine brought them here, and how often the contact email is clicked, we use Plausible Analytics, provided by Plausible Insights OÜ (Estonia, EU). Its data is stored on servers in the EU.

Plausible uses no cookies and stores nothing on your device. It does not store your IP address: it uses it only briefly, together with your browser type, to count unique visitors per day, and that daily identifier is discarded every 24 hours. From the IP address it derives only your country and region. We see totals only, never individual visitors, and the statistics are not used to identify you, build profiles or show ads.

Legal basis: our legitimate interest in understanding how the website is used so we can improve it (GDPR Art. 6(1)(f)).

The Bluepow app

The app is in development. This section describes how it will handle data when it launches. If anything changes before then, we will update it here first.

What the app needs to work

  • Your resorts and settings. The resorts you follow, the odds and snow depths you choose for alerts, and your language. We use them to show your forecasts and send your alerts. You don’t need an account: these settings belong to your device.
  • Notifications. If you turn on alerts, Apple or Google gives the app a push token so we can send them. You can turn alerts off at any time in the app or in your phone's settings.
  • Location, only if you allow it. Resorts near you can start from your current location, or from a place you type in. If you use your location, the app reads it only while it is open and rounds it to about 1 km. The rounded point may be sent to our servers, or to a routing provider to work out driving distances, only to find resorts near you. We do not store it or keep a history of where you have been. Directions open in Apple Maps or Google Maps. We will name the routing provider here before launch.

Legal basis: providing the app you asked for (GDPR Art. 6(1)(b)), and your consent for location and notifications, which you can withdraw at any time (GDPR Art. 6(1)(a)).

Subscriptions and payments

Plus is bought and managed through the Apple App Store or Google Play. They handle the payment, and we never see your card details. They tell us whether you have an active trial or subscription, so we can unlock Plus, and they give us sales reports, such as how many trials turned into paid subscriptions.

Legal basis: performing your subscription (GDPR Art. 6(1)(b)) and our legal duties to keep accounting records (GDPR Art. 6(1)(c)).

Usage statistics, only with your consent

To improve the app and understand whether Plus is worth paying for, we would like to count how the app is used: for example, which screens are opened, when a trial starts, and whether it becomes a paid subscription. The app asks first, and collects these statistics only if you say yes. You can change your answer at any time in the app's settings.

These statistics are linked to a random app ID, not to your name or email. We do not use advertising IDs, we do not track you across other apps or websites, and we do not use the statistics for advertising. Before launch, we will name the analytics provider here and say where it processes data. We delete the raw statistics after at most 14 months.

Legal basis: your consent (GDPR Art. 6(1)(a)).

Deleting your app data

Deleting the app removes the data stored on your phone. To delete the data we hold on our side, email us and we will do it within 30 days. Records of purchases are kept only as long as accounting law requires.

When you email us

If you email us, we use your email address and your message only to reply to you and handle your request.

Legal basis: your request and our legitimate interest in answering it (GDPR Art. 6(1)(b) and (f)).

Email to our domain is forwarded through Squarespace's email forwarding, which uses Mailgun Technologies, Inc. (USA). We keep emails only as long as needed to handle your request, and for at most 12 months afterwards, unless the law requires us to keep them longer or you ask us to delete them sooner.

Who else sees your data

Only the service providers named above (and, once the app launches, Apple, Google and the providers we will name in the app section), and only to provide their service to us. We do not sell or rent personal data, and we do not share it with advertisers.

Your rights

You can ask us at any time for access to your data, to correct it, to delete it, to restrict or object to its use, or to receive it in a portable format. Email us at contact@bluepow.eu.

You can also complain to a data protection authority: in Switzerland, the Federal Data Protection and Information Commissioner (FDPIC); in the EU, the authority in your country of residence.

Changes

If we add features that handle more data, we will update this policy before they go live and change the date above. If a change needs your consent, the app will ask you again.
